Personal Injury Traffic Crash

IRON MOUNTAIN -- Just after 3:40 p.m. Thursday Troopers from the Iron Mountain State Police responded to a report of a personal injury traffic crash.

The accident occurred on M-95 near Cabris Road in Sagola Township.

The driver, 21-year-old Eli Johnson of Foster City, was traveling north on Highway M-95 when a deer ran onto the road. Johnson would collide with the deer causing it to vault into the windshield after impact.

Johnson was transported to Dickinson County Memorial Hospital for treatment of his injuries.

A seat belt was worn and alcohol is not a contributing factor in this crash.

The case involved a personal injury claim that emerged from a criminal case, where the State of Florida charged Jose Alvarez, a Miami roofer, with aggravated battery with a deadly weapon for severely beating his co-worker, Derrick Roy Flemmings, with a baseball bat.

The attack occurred at their place of employment, a roofing company called Professional Roofing and Sales, located in Miami. In the criminal proceedings, the trial judge conducted an evidentiary hearing that included testimony from both Mr. Alvarez and his wife, as well as Mr. Flemmings.
